Federal Court Mandates Release of Kilmar Abrego Garcia from Immigration Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The situation stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to face human smuggling charges, he was detained in federal custody.

In her order, the court noted that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."

The legal proceedings center on conflicting assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in Tennessee.
